In most states, once your initial Medicare Supplement enrollment window closes, changing plans means answering health questions - and if your health has changed, you can be turned down. That is how people end up stuck paying more every year for a policy they cannot leave. Oklahoma is one of only eight states that fixed this. Every year, on your birthday, you get a window to switch carriers with no medical underwriting at all.
What the Rule Actually Says
Under Oklahoma Administrative Code 365:10-5-129(f), effective September 1, 2023, any Medicare Supplement issuer doing business in Oklahoma must offer a current Medigap policyholder a new policy with the same or lesser benefits, without medical underwriting and without new pre-existing condition exclusions. Carriers satisfy the requirement by providing a 60 calendar day open enrollment period that begins on your birthday each year.

One piece of terminology the Insurance Department is firm about. This is an open enrollment, not a guaranteed issue right. The distinction is not academic - guaranteed issue situations under federal law are triggered by specific events like losing employer coverage, and they carry different rules. The birthday rule is an annual Oklahoma-specific opportunity layered on top of those. If someone uses the two terms interchangeably, they may not know the difference.
Which Plans You Can Move To
Because the rule is limited to same or lesser benefits, where you can go depends on where you are. The Oklahoma Insurance Department publishes a replacement matrix. In plain terms:

Read that Plan G row again, because it is the useful one. Most Oklahomans new to Medicare are on Plan G. That means every single year you can shop your Plan G against every other carrier’s Plan G in the state, with no health questions asked. Same benefits, same federal standardization, potentially a materially lower premium. Most people never do it, and it costs them.
One more detail worth knowing: innovative benefits are not treated as significant benefits under Oklahoma’s rules. So plans built with an innovative discount rider are reachable through the birthday window rather than being blocked as an upgrade.
Why This Matters More Than It Sounds
Medicare Supplement benefits are standardized by federal law. A Plan G from one carrier pays exactly what a Plan G from another carrier pays. The doctor cannot tell the difference and neither can the hospital. What differs between carriers is price, how the price changes as you age, and service.
That has a consequence people rarely think through. Most Oklahoma Medigap plans are attained-age rated, which means the premium climbs every year as you get older, on top of the general increases every carrier files. A plan that was competitively priced at 65 can be well out of line by 78. In a state without a birthday rule, that is when you are trapped: your health has probably changed, underwriting would catch it, and you cannot leave.
Oklahoma’s rule breaks that trap. Every birthday, for 60 days, your health stops mattering. You can move your Plan G to whichever carrier is priced best right now. The benefits are identical by law. This is the single most valuable thing an Oklahoma Medigap holder can know, and the overwhelming majority never hear about it.
How to Actually Use It
- Know your window. It opens on your birthday and runs 60 calendar days. Miss it and you wait a year.
- Do not cancel anything first. Apply for the new policy, get it approved and issued, and only then end the old one. A gap over 90 days breaks your eligibility.
- Compare the same letter. Plan G to Plan G is an apples-to-apples price comparison because the benefits are federally identical.
- Look at the rate structure, not just the premium. Moving to another attained-age plan solves this year’s problem. Understanding what you are moving into solves the next decade’s.
- Check it every year, even if you are happy. Carriers file rate increases at different times. The best-priced plan changes.
If You Are Under 65 on Disability
The birthday rule applies to you. There is also a separate protection worth knowing: under OAC 365:10-5-129(g), carriers must notify Medicare enrollees who qualified through disability about their Medigap open enrollment eligibility at age 65 - between 60 and 90 days before the first day of the month you turn 65.
That matters because turning 65 on Medicare disability gives you a fresh six month Medigap open enrollment period, with full access to any plan regardless of health. If you enrolled under 65 and are approaching that birthday, it is one of the most important windows you will get. Do not let it pass by default.
Which States Have a Birthday Rule
Oklahoma joined a short list in September 2023. The others are California, Idaho, Illinois, Louisiana, Maryland, Nevada and Oregon. If a friend in another state tells you switching Medigap plans requires underwriting, they are probably right where they live - and wrong about Oklahoma.
